Terms & Conditions

1. Scope
These Terms govern the agreement between Mindex (pinedapps) (Owner: Diego Felipe Pineda Leiva) ("Mindex") and individuals or organisations ("Users") for the use of our web app, mobile clients, and APIs.

2. Account creation

• The agreement starts once you complete registration and confirm your email.
• Users must be at least 16 years old and provide accurate information.
• Accounts are non-transferable and credentials must remain confidential.
• Mindex may decline registrations for legitimate reasons.

3. Services
Mindex provides a private cloud platform for bookmarking, knowledge organisation, file storage, and AI-assisted categorisation. Mindex offers a Free plan and may offer paid Pro plans or add-ons. Every plan has fair technical and economic limits for storage, spaces, projects, cards, project assignments, categories, AI usage, and other resource-intensive features. Pro means higher limits and additional features, not unlimited use.

4. Fees & payment
At launch, paid Pro plans are sold only inside the iPhone and Android apps through Apple App Store or Google Play. The web app does not sell Pro directly for now; it can display and use an active mobile Pro entitlement after it syncs. Paid plans, in-app purchases, or add-ons are only sold after the price, billing period, included limits, renewal terms, cancellation options, and payment provider are shown clearly before purchase. Mindex does not use donations or tips as a substitute for paid digital features.

5. Term, export & termination

• Free accounts run indefinitely and can be ended anytime through account deletion or a written request.
• Users can request a JSON export of their account data before deletion.
• If a paid Pro plan is cancelled, refunded, not renewed, or cannot be charged, the account returns to the Free plan after the paid period ends unless another entitlement remains active, such as grandfathered access. Existing content generally remains readable, exportable, and deletable. New uploads, new spaces, projects, cards, project assignments, categories, Pro features, and paid AI actions may be blocked while the account is over Free limits or lacks active Pro entitlement. Content is not automatically deleted only because Pro ends.
• Both parties may terminate for cause (e.g., abuse or legal violations).

6. Content rights and user responsibility
Users retain ownership of their content and grant Mindex a non-exclusive, geographically limited licence only as needed to provide, store, sync, back up, analyse, and display the services. Users are solely responsible for content they save, upload, import, or submit for analysis. Only upload content you have sufficient rights to and respect applicable law, privacy rights, personality rights, copyrights, trademarks, and other third-party rights.

7. Acceptable use
Mindex is designed for private use and v1 does not provide a public sharing, social, or UGC platform. Mindex does not proactively monitor private user content and is not responsible for content that users save, import, upload, or submit for analysis. It is forbidden to use the platform for malware, spam, unlawful, abusive, discriminatory, violent, pornographic, child-endangering, or otherwise illegal content, privacy violations, copyright/trademark/personality-rights violations, security bypassing, abusive scraping, harassment, or unlawful publication of confidential information. If violations or credible abuse reports occur, Mindex may remove content, restrict access, suspend or delete accounts, preserve evidence, and notify authorities. 7a. AI and no professional advice
AI features are assistive only. Outputs may be inaccurate, incomplete, or unsuitable and do not replace medical, legal, financial, tax, safety, or other professional advice. Users must review AI output before saving, sharing, or using it.

8. Availability & maintenance
We target 99% monthly availability. Planned maintenance windows are announced in advance. In case of outages, Mindex will take reasonable steps to restore service.

9. Warranty & liability
Mindex is fully liable for intent, gross negligence, and damages to life, body, or health. For simple negligence we only cover essential contractual duties and limit compensation to foreseeable damages. Product liability remains unaffected.

10. Changes to these Terms
We may amend these Terms for valid reasons (legal changes, feature updates). We will notify you at least 30 days in advance. Continued use without objection constitutes acceptance. If you object, Mindex may terminate the agreement with 30 days' notice.

11. Governing law & worldwide use
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, the place of jurisdiction is Kempten (Allgäu), where legally permitted. Mandatory consumer and privacy protections in your country of residence remain untouched. You are responsible for using Mindex only in compliance with locally applicable law, export control, and sanctions rules.
